1. Agreement to Terms

By engaging Lawn Legend's services or using our website, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services or website.

2. Services Provided

Lawn Legend provides professional lawn care services including, but not limited to:

• Lawn mowing and trimming
• Mulching
• Spring and fall cleanup
• Other landscaping services as agreed upon

All services are subject to availability and will be performed in accordance with industry standards and best practices.

3. Service Area

Our services are currently available in:

• Martinsburg, WV
• Ranson, WV
• Charles Town, WV
• Hedgesville, WV
• Berkeley Springs, WV
• Spring Mills, WV
• Inwood, WV

Service availability outside these areas is at our sole discretion.

4. Quotes and Pricing

All quotes are estimates based on the information provided by the customer. Final pricing may vary based on actual property conditions, accessibility, and scope of work required.

Prices are subject to change without notice. Quoted prices are valid for 30 days from the date of the quote unless otherwise specified.

5. Payment Terms

• Payment is due upon completion of services unless other arrangements have been made in advance
• We accept cash, check, and major credit cards
• For recurring services, payment schedules will be agreed upon in advance
• Late payments may incur a fee of 1.5% per month or the maximum rate allowed by law
• Services may be suspended for accounts with outstanding balances

6. Scheduling and Cancellations

By Customer

• Cancellations or rescheduling requests must be made at least 24 hours in advance
• Cancellations made with less than 24 hours notice may incur a cancellation fee
• For recurring services, customers may pause or cancel services with 7 days written notice

By Lawn Legend

• We reserve the right to reschedule services due to weather conditions, equipment failure, or other unforeseen circumstances
• Customers will be notified as soon as possible of any schedule changes
• We will make reasonable efforts to reschedule services at the earliest convenient time

7. Property Access and Safety

Customers agree to:

• Provide clear access to the property and work areas
• Inform us of any obstacles, hazards, or underground utilities
• Remove or secure pets during service
• Mark or identify any sensitive landscaping, irrigation systems, or underground utilities
• Ensure all gates are unlocked on the scheduled service day (for recurring services)

We are not responsible for damage to unmarked or hidden obstacles, including but not limited to irrigation systems, underground utilities, decorative items, or landscaping features.

8. Weather-Related Services

Services may be delayed or postponed due to inclement weather, including but not limited to rain, snow, or extreme temperatures. We will reschedule weather-delayed services as soon as conditions permit.

9. Customer Responsibilities

Customers are responsible for:

• Providing accurate property information and special requirements
• Maintaining reasonable access to the property
• Notifying us of any changes to property conditions or access
• Ensuring that property is free from hazards that could affect service delivery
• Timely payment for services rendered

10. Liability and Warranties

Service Warranty

We stand behind the quality of our work. If you are not satisfied with our services, please contact us within 24 hours of service completion, and we will address your concerns.

Limitation of Liability

To the fullest extent permitted by law:

• Our liability is limited to the cost of the services provided
• We are not liable for damage to unmarked obstacles or hidden items
• We are not liable for damage caused by pre-existing conditions of the property
• We are not responsible for acts of nature or weather-related damage
• We maintain appropriate liability insurance for our operations

11. Intellectual Property

All content on our website, including text, graphics, logos, images, and software, is the property of Lawn Legend and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

12. Dispute Resolution

Any disputes arising from these Terms and Conditions or our services will be resolved through good faith negotiation. If negotiation fails, disputes will be resolved through binding arbitration in accordance with the laws of West Virginia.

13. Indemnification

You agree to indemnify and hold harmless Lawn Legend, its employees, and contractors from any claims, damages, or expenses arising from your breach of these Terms and Conditions or your use of our services.

14. Severability

If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes are posted constitutes your acceptance of the modified terms.

16. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of West Virginia, without regard to its conflict of law provisions.

17. Entire Agreement

These Terms and Conditions, along with our Privacy Policy, constitute the entire agreement between you and Lawn Legend regarding our services and supersede all prior agreements and understandings.
